Florida Exploitation of the Elderly

Florida’s elderly residents receive specific protections under Florida law. While there are criminal penalties for exploitation of the elderly, businesses who serve elderly consumers may also be sued for civil damages under claims that they exploited an elderly consumer or fiduciary. For instance, Fla. Stat. 415.1111 establishes the right to a civil action for exploitation of the elderly. In certain situations, it permits an elderly plaintiff to recover their attorney’s fees and costs (in addition to damages) for another party taking advantage of them where a fiduciary relationship is owed to them. This statute may be used in a business context to seek relief for elderly plaintiffs litigating against businesses in Florida.
